When Jeffrey Piccolo’s wife died in 2023 from an allergic reaction in a Disney World restaurant, he filed a wrongful death case against Disney.
Doctor Kanokporn Tangsuan was the spouse of Piccolo; she died on October 5, 2023. At NYU Langone Hospital, she was employed.

He prosecuted the business, and he claimed that the restaurant and its employees had been negligent. He was seeking $50,000 in damages after his wife passed away.

The complaint seeks to make the business accountable for failing to provide adequate training to guarantee that food is free of allergies. Since then, the matter has continued, but the business is now requesting that the courts dismiss the action.

Disney asks the court to put an end to the case and order arbitration to resolve the disagreement. The business claims that arbitration, not court cases, is required to resolve issues under the conditions of use.

The business claims that when Piccolo signed up for a free one-month trial of Disney+ in 2019, he agreed to these terms. The business points out that in 2023, when Piccolo used his Disney account to purchase theme park tickets, he once more consented to these terms.

Mr. Piccolo asserts that despite being frequently warned of his wife’s severe nut and dairy allergies, the Disney Springs restaurant at Disney World in Orlando, Florida, where he had dinner with his mother in October 2023, did not sufficiently handle the issue.

Tangsuan placed an order for fritters, onion rings, and scallops at the Raglan Road Irish Pub and Restaurant, which is where the incident took place.

According to the lawsuit, the family discussed Tangsuan’s allergies with their server multiple times.

The lawsuit notes,

When the waiter returned with [Tangsuan’s] food, some of the items did not have allergen-free flags in them, and [Tangsuan] and [Piccolo] once again questioned the waiter who, once again, guaranteed the food being delivered to [Tangsuan] was allergen-free.
